Welcome to MyFuneralManager. These Terms and Conditions govern your use of the MyFuneralManager cloud-based funeral management platform and related services.
By accessing or using our Service, you agree to be legally bound by these Terms and Conditions.
1. Introduction
1.1
We are MyFuneralManager, a UK-based provider of cloud-based funeral management software and related digital services for funeral homes, mortuaries, crematoria, transport providers, embalmers, and related professionals.
1.2
Our platform is designed to help funeral professionals manage funeral operations, deceased records, transportation logistics, care procedures, documentation, client arrangements, and related administrative workflows.
1.3
Our company information is provided at the end of these Terms.
2. Definitions
In these Terms and Conditions:
a) “Account” means a registered user account used to access the Service.
b) “Content” means all information, records, documents, images, notes, messages, forms, reports, and data uploaded to or generated within the Service.
c) “Customer” means any funeral home, funeral director, mortuary, crematorium, business, organisation, or authorised user using the Service.
d) “Deceased Data” means records and information relating to deceased persons handled through the Service.
e) “Free Trial” means the 30-day trial period offered by MyFuneralManager.
f) “Mobile Device” means any smartphone, tablet, or portable device capable of accessing the Service.
g) “Service” means the MyFuneralManager website, cloud platform, mobile-friendly application, and associated software services.
h) “Subscription” means a paid monthly access plan to the Service.
i) “User” means any individual authorised to access the Service through a Customer account.
j) “Website” means MyFuneralManager.
3. About These Terms
3.1
These Terms and Conditions apply to all Users and Customers of the Service.
3.2
By registering for, accessing, or using the Service, you enter into a legally binding agreement with MyFuneralManager.
3.3
You should save or print a copy of these Terms for future reference.
3.4
These Terms are available only in English.
4. Changes to These Terms
4.1
We may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or operational practices.
4.2
Where significant changes are made, we will provide reasonable notice via email or through the Service.
4.3
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
5. Free Trial and Cancellation Rights
5.1
We may offer a 30-day Free Trial to eligible Customers.
5.2
At the end of the Free Trial period, access may be suspended unless a paid Subscription is activated.
5.3
Customers may cancel their Subscription at any time through their account settings or by contacting support.
5.4
Unless required by law, Subscription payments are non-refundable once paid.
5.5
Nothing in these Terms affects your statutory rights under UK consumer law.
6. Use of the Service
6.1
We grant you a limited, non-transferable, non-exclusive right to use the Service in accordance with these Terms.
6.2
You must only use the Service for lawful funeral industry and business purposes.
6.3
You must be at least 18 years old to use the Service.
6.4
You are responsible for ensuring all Users within your organisation comply with these Terms.
6.5
You must ensure login credentials remain confidential and secure.
7. Funeral Industry Compliance
7.1
Customers are solely responsible for ensuring their use of the Service complies with all applicable laws, regulations, professional standards, and codes of practice relating to funeral services, mortuary care, deceased handling, transportation, cremation, burial, and data protection.
7.2
MyFuneralManager does not provide legal, regulatory, or compliance advice.
7.3
Customers remain solely responsible for:
- Deceased identification procedures
- Legal documentation
- Cremation and burial paperwork
- Chain-of-custody procedures
- Mortuary compliance
- Transportation compliance
- Record retention obligations
- GDPR obligations relating to personal data
8. Sensitive Data and GDPR
8.1
The Service may store sensitive personal data, including information relating to deceased individuals, families, funeral arrangements, and staff.
8.2
All live data and backup data associated with the Service is stored and processed within the United Kingdom and/or Ireland.
8.3
We process personal data in accordance with applicable UK GDPR and Data Protection legislation.
8.4
Customers are responsible for ensuring they have a lawful basis for uploading and processing all personal data entered into the Service.
8.5
Users must ensure appropriate security measures are taken to protect account access and sensitive information.
9. Acceptable Use
9.1
You agree not to:
a) Use the Service unlawfully;
b) Upload malicious software or harmful code;
c) Attempt unauthorised access to the Service;
d) Interfere with platform security or performance;
e) Upload false, misleading, abusive, or unlawful content;
f) Use the Service to compete directly with MyFuneralManager;
g) Reverse engineer or copy the software;
h) Share login credentials with unauthorised individuals.
9.2
We reserve the right to suspend or terminate accounts that breach these Terms.
10. Customer Content
10.1
Customers retain ownership of all Content uploaded to the Service.
10.2
You grant us permission to host, store, process, transmit, and back up Content solely for the purpose of providing the Service.
10.3
You are responsible for ensuring all uploaded Content is accurate and lawful.
10.4
We may remove Content that breaches these Terms or applicable laws.
10.5
Customers are responsible for maintaining their own backups where appropriate.
11. Availability of Service
11.1
We aim to provide reliable access to the Service but do not guarantee uninterrupted or error-free availability.
11.2
The Service may occasionally be unavailable due to:
- Maintenance
- Updates
- Security incidents
- Network failures
- Third-party provider outages
- Events outside our control
11.3
We may modify, improve, or discontinue features at any time.
12. Subscription and Payment
12.1
Access to certain features requires a paid monthly Subscription.
12.2
Subscription pricing is displayed on the Website.
12.3
Payments are charged in advance on a recurring monthly basis.
12.4
Subscriptions automatically renew unless cancelled before the renewal date.
12.5
Failure to pay may result in suspension or termination of access.
12.6
We reserve the right to change pricing with reasonable notice.
13. Intellectual Property
13.1
All intellectual property rights relating to the Service, software, branding, graphics, and Website remain the property of MyFuneralManager.
13.2
You may not:
- Copy
- Resell
- Modify
- Distribute
- Reverse engineer
- Reproduce
any part of the Service without written permission.
13.3
The name “MyFuneralManager” and associated branding may not be used without authorisation.
14. Limitation of Liability
14.1
Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot legally be excluded
14.2
To the fullest extent permitted by law, MyFuneralManager shall not be liable for:
- Loss of profits
- Loss of business
- Loss of data
- Loss of reputation
- Indirect or consequential losses
- loss or corruption of backup data;
- inability to restore archived records;
- temporary or permanent loss of access to stored information;
14.3
Customers remain fully responsible for all funeral operations and professional decisions made using the Service.
14.4
Our total liability arising under these Terms shall not exceed the total Subscription fees paid by the Customer during the previous 12 months.
15. Suspension and Termination
15.1
Customers may terminate their Subscription at any time.
15.2
We may suspend or terminate access if:
- These Terms are breached
- Payments are overdue
- Illegal activity is suspected
- Security risks arise
- Required by law
15.3
Upon termination:
- Access to the Service may cease immediately
- Data may be deleted after a reasonable retention period
- Outstanding fees remain payable
16. Data Retention
16.1
We may retain certain data after account closure where required for:
- Legal compliance
- Security
- Dispute resolution
- System integrity
- Backup purposes
16.2
Customers are responsible for exporting any required records before account closure.
16A. Backups and Data Storage
16A.1
MyFuneralManager performs routine system and database backups to support service continuity, disaster recovery, and operational resilience.
16A.2
Backup data and live operational data may be securely stored and processed within data centres located in the United Kingdom and Ireland.
16A.3
While we take reasonable technical and organisational measures to protect Customer data, we do not guarantee that backups will always be available, complete, error-free, or capable of full restoration in every circumstance.
16A.4
Customers acknowledge that they remain responsible for maintaining their own copies and exports of any important records, reports, documents, or data uploaded to the Service.
16A.5
To the fullest extent permitted by law, MyFuneralManager shall not be liable for:
- loss of backup data;
- corruption of stored data;
- incomplete restorations;
- accidental deletion;
- system failures;
- cyber incidents;
- third-party infrastructure failures; or
- any consequential loss arising from data loss or restoration issues.
16A.6
Customers are encouraged to regularly export and securely retain copies of critical operational and deceased records where required for compliance or business continuity purposes.
17. Third-Party Services
17.1
The Service may integrate with or link to third-party services.
17.2
We are not responsible for third-party platforms, services, or content.
18. Force Majeure
18.1
We are not liable for delays or failures caused by circumstances outside our reasonable control including:
- Internet outages
- Cyber attacks
- Natural disasters
- Power failures
- Government actions
- Pandemics
19. Governing Law
19.1
These Terms are governed by the laws of England and Wales.
19.2
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
